Pima County Superior Court Uniform Conditions of Probation

If sentenced for a crime in Pima County Superior Court (these are crimes that were originally charged as felonies), and a person is placed on probation, the person should be prepared to abide by the Uniform Conditions of Supervised Probation.  If the terms are not complied with, Judges commonly send probation violators to a term of incarceration in the Department of Corrections.

When placed on probation, probationers will be required to sign off acknowledging having read and agreed to the conditions of probation.  Those conditions include:

Law Abiding Behavior

  1. Maintain a crime-free lifestyle by obeying all laws, and not engaging or participating in any criminal activity.

  2. No possession or control any stun guns, tasers, firearms, ammunition, deadly or prohibited weapons as defined in A.R.S. § 13-3101.

  3. Report any contact I have with law enforcement to the adult probation department within 72 hours.

  4. Submit to search and seizure of person and property by the adult probation department without a search warrant.

  5. If deported or processed through voluntary departure, not return to the United States without legal authorization during the term of my probation. If deported or processed through voluntary departure, all conditions remain in effect.

Reporting to Probation

  1. Report to the adult probation department within 72 hours of sentencing, absolute discharge from prison, release from incarceration, or residential treatment and continue to report as directed. Keep the adult probation department advised of progress toward case plan goals and comply with any written directive of the adult probation department to enforce compliance with the conditions of probation. Provide a sample for DNA testing if required by law.

Residence

  1. Provide the adult probation safe, unrestricted access to residence and receive prior approval of the adult probation department before changing residence. Reside in a residence approved by the adult probation deparmtnt.

  2. Request and obtain written permission of the adult probation department prior to leaving the state/county.

  3. May apply for Interstate Compact supervision in other states and will not proceed to that state until reporting instructions are received and the adult probation department issues a written travel permit.

  4. May apply for an Inter-County transfer and will not proceed to that County until adult probation department issues written authorization.

Treatment/Behavior Change/Pro-Social Activities

  1. Actively participate and cooperate in any program of counseling or assistance as determined by the adult probation department, or as required by law, given assessment results and/or behavior. Sign any release or consent required by the adult probation department so the adult probation department can exchange information in relation to treatment, behavior and activities.

  2. Not possess or use illegal drugs or controlled substances and submit to drug and alcohol testing as directed by the adult probation department.

  3. Obtain written approval of the adult probation department prior to associating with anyone with a criminal record. Not knowingly associate with any person engaged in criminal behaviors.

  4. Seek, obtain, and maintain employment, if legally permitted to do so, and/or attend school. Inform the adult probation department of any changes within 72 hours.

  5. Be financially responsible by paying all restitution, fines, and fees as imposed by the Court. If restitution is not paid in full, the Court may extend probation.

  6. Not consume or possess any substances containing alcohol.

Special Requirements

  1. Complete a prescribed number of hours of community restiuttion.  Complete the set number of hours per month as directed in writing by my probation officer.  Complete those hours at a site approved by the adult probation department.

  2. Serve a prescribed amont of time in jail.

  3. Do not have any contact with the victim(s) in any form, unless approved in writing by the adult probation department.

  4. Comply with additionsl sanctions on behavior including additional community restitution and jail.

  5. Abide by special conditions for either (Intensive probation, domestic violence, mental health, sex offender, drug court, DUI, gang).
